Implied Consent In Virginia

Virginia has implied consent laws meaning that you cannot refuse blood or breath test. If you do refuse, your license will be suspended for one year and you will not be eligible for any restricted driving privileges
DUI Penalties In Virginia
If you are convicted of a DUI, the penalties are as follows:
- First offense: One-year license suspension
- Second offense: License suspended for three years and possible one-year jail time
- Third offense: Indefinite license suspension, possible 90-day jail term to six-month jail term
- Fourth offense: Mandatory one-year minimum jail sentence
If you have a blood alcohol level of .15 or higher, the penalties will be more severe even if it is your first offense.
